These Terms & Conditions ("Agreement") govern your use of the Photoshoot AI online service ("Service"), provided by Photoshoot AI ("Company," "we," or "us"). By accessing or using the Service, you agree to be bound by this Agreement.

1. User Registration

1.1 By signing up for the Service, you represent that you are at least 18 years old or have the necessary legal consent to use the Service. You may sign up using your email and password or through third-party social logins (e.g., Google, Facebook, Microsoft).

1.2 During the registration process, you may be required to provide personal information, including but not limited to your gender, ethnicity, and age. This information is optional and used solely to enhance the accuracy of the custom model generation.

2. Image Uploads

2.1 You may upload up to 30 pictures of your face in JPG, PNG or GIF format. By uploading these images, you confirm that you have the necessary rights and permissions to use and share the uploaded content.

2.2 You understand and acknowledge that the quality and accuracy of the generated images are dependent on the quality and variety of the pictures you upload.

3. Custom Model Generation

3.1 Upon uploading your images, our Service will generate a custom model based on your provided pictures. The model generation process typically takes between 15 to 20 minutes.

4. Image Generation

4.1 Once the custom model is generated, you will have access to various options, including selecting locations, backgrounds, outfits, and more, to generate professional images.

4.2 The base plan you purchase provides you with 10 credits, which can be used to generate images. Additionally, you have the option to purchase a top up for 100 additional credits. The top up can be purchased multiple times.

4.3 We do not guarantee the quality or absence of AI artifacts in the generated images. You acknowledge that the images are provided "as is" and use them at your own risk.

5. Ownership of Generated Images

5.1 You retain full ownership of the generated images produced through our Service.

6. Privacy and Data Protection

6.1 We respect your privacy and handle your personal information in accordance with our Privacy Policy. The images you upload are solely used for training the custom model and are deleted from our servers after the training process is completed.

7. User Responsibilities

7.1 You agree to use the Service in compliance with applicable laws and regulations.

7.2 You shall not upload pictures of minors or any explicit or inappropriate content.

8. Intellectual Property

8.1 The custom model, software, algorithms, and all associated intellectual property rights related to the Service are owned by the Company.

9. Limitation of Liability

9.1 The Company shall not be held liable for any inaccuracies, imperfections, or AI artifacts in the generated images. The quality and resemblance of the images to the user are dependent on the uploaded pictures.

10. Termination of Service

10.1 The Company reserves the right to terminate or suspend your access to the Service at any time, without prior notice, for any reason, including but not limited to violation of this Agreement.

10.2 The Company may remove any generated images and user data in the event of termination or suspension of the Service.

11. Refunds

11.1 All purchases made for credits or addons are non-refundable. Once you have purchased credits or addons, no refunds will be provided for any reason, including but not limited to user dissatisfaction, changes in preferences, or account termination.

11.2 You acknowledge and agree that the purchase of credits or addons is final and that you will not seek a refund from the Company.

11.3 In the event of termination of your access to the Service due to a violation of this Agreement or any other reason, you will not be entitled to a refund for any remaining credits.

11.4 The Company reserves the right to make exceptions to this refund policy in its sole discretion, such as in cases of technical issues or errors caused by the Service. Any such exceptions will be determined on a case-by-case basis.
